Terms of Service
Effective August 29, 2026
These are SwiftSpec's beta terms. They are in effect now. We will update them when legal review is complete, and material changes will be announced in the app before they take effect.
1. Agreement
These Terms of Service (the “Terms”) are a binding agreement between SwiftSpec (“SwiftSpec,” “we,” “us”) and you. By creating an account or using any part of the Service, you agree to them. If you are accepting on behalf of a firm, you represent that you have authority to bind it, and “you” means that firm. The Service is offered to businesses and professionals. You must be at least 18.
2. The Service
The “Service” is the SwiftSpec web application at swiftaec.com. It includes SwiftSpec Studio, the site lookup, stacking, outline, catalog, and interiors tools, the plugin tools, and the SwiftSpec master specification library and related data (the “Master Library”). The Service is a productivity tool for drafting construction specifications. It is not an architecture, engineering, or code-consulting service.
3. Your license, and what stays ours
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service, including the Master Library, to prepare construction specifications for your own projects or your clients’ projects. The Service and Master Library are licensed, not sold. We and our licensors retain all right, title, and interest in them.
You will not, and will not permit anyone else to:
- copy, bulk-download, scrape, or systematically extract the Master Library or any substantial portion of it;
- redistribute, resell, or make the Master Library or the Service available to third parties, including in any competing product or specification library;
- use the Master Library or Service output to train a machine-learning model, or to develop a competing product;
- reverse engineer the Service or circumvent authentication or access controls;
- share account credentials.
4. Your projects and output
You retain all rights in the project data you enter (“Your Content”). We host and process it solely to provide the Service. Documents you generate for a specific project (“Output”) are yours. You have a perpetual, royalty-free license to reproduce and distribute Master Library content as embedded in that project’s Output, including construction documents, addenda, and archives, even after your subscription ends. This does not permit extracting library content from Output to build a specification library or any use prohibited by Section 3.
5. Professional responsibility. Read this section.
The Service provides drafting tools and editable reference content. We are not a licensed architect, engineer, or code consultant. Nothing in the Service or its output is architectural, engineering, legal, or code-compliance advice, and no professional-client relationship is created.
- All Output must be reviewed, completed, verified, and approved by a design professional licensed in the project’s jurisdiction before it is issued, relied upon, or used for permitting, bidding, or construction. You, not we, are solely responsible for the accuracy, completeness, coordination, and code compliance of every document you issue.
- Climate zones, seismic and wind values, occupancy and egress values, energy-code values, and similar data surfaced by the Service are drafting aids. They may be incomplete, outdated, or inapplicable to your jurisdiction’s adopted codes and amendments. You must verify them independently against the codes actually adopted by the authority having jurisdiction.
- Values you enter from copyrighted standards (for example ASHRAE 90.1) come from your own licensed or lawfully accessed copy. You are responsible for complying with those licenses.
- We do not warrant that any Master Library section, bracket option, product listing, or calculated value suits any particular project.
6. Term and termination
You may stop using the Service at any time. We may suspend or terminate access for material breach of these Terms or where required by law. On termination your license to the Service and Master Library ends; your Output license (Section 4) and Sections 5 and 7 through 9 survive, and your project data remains exportable for 30 days before we may delete it.
7. Disclaimer of warranties
THE SERVICE, THE MASTER LIBRARY, AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT CONTENT IS CURRENT, COMPLETE, OR COMPLIANT WITH ANY CODE OR STANDARD.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION; (b) WE WILL NOT BE LIABLE FOR ANY CLAIM ARISING FROM CONSTRUCTION MEANS OR RESULTS, INCLUDING DESIGN OR SPECIFICATION ERRORS OR OMISSIONS IN ISSUED DOCUMENTS, CODE VIOLATIONS, PERMIT DENIALS, PROJECT DELAYS, DEFECTS, OR PROPERTY DAMAGE OR PERSONAL INJURY ARISING FROM CONSTRUCTION, ALL OF WHICH ARE THE RESPONSIBILITY OF THE DESIGN PROFESSIONAL OF RECORD AND THE PROJECT PARTICIPANTS; AND (c) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS IF YOU HAVE PAID NOTHING.
9. Indemnification, governing law, general
You will defend and indemnify SwiftSpec against third-party claims arising from documents you issue or use on any project, Your Content, or your breach of these Terms. These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws rules, and disputes belong exclusively to the state or federal courts located in Marion County, Indiana. We may update these Terms. Material changes will be announced in the app before taking effect, and continued use after the effective date constitutes acceptance. If a provision is unenforceable, the rest remain in effect.
